An expert witness owes an overriding duty to the tribunal, not to the party paying the fees. Expert evidence is only valuable if it is independent, rigorous and clearly explained, tribunals see through advocacy dressed as expertise.

What is the expert’s duty?+

Under CPR Part 35 the expert’s overriding duty is to help the tribunal on matters within their expertise. That duty overrides any obligation to the instructing party, independence is the source of an expert’s value.

What is a "quantum" expert?+

A quantum expert values the money in dispute: variations, loss and expense, disruption, prolongation, valuation of work done and final-account differences.

Can one person be both expert and arbitrator on a matter?+

No. The roles are kept strictly separate. On any given dispute KHAN ADRS acts in one capacity only, and conflict checks ensure independence.
